今（3）日，徐熙媛（大S）的家属证实，大S在日本旅游期间因病去世，年仅48岁。 大S去世后，关于其一双儿女的抚养权问题引发外界关注。 大S与汪小菲 大S和前夫汪小菲育有一女一子。大女儿出生于2014年4月，小儿子出生于2016年5月。在大S和汪小菲离婚后，两名孩子的抚养权都归大S。不过，自从大S再婚后，汪小菲开始争夺孩子的抚养权。 如今，随着大S的去世，孩子的抚养权是否会回到汪小菲这里？不少网友感叹，希望能妥善处理，避免孩子成为双方家庭纠结不清、拉扯战的无辜对象。 今日，红星新闻记者试图联系汪小菲，但暂未得到回应。 四川简法律师事务所合伙人吴胤征律师认为，一般而言，父母离婚后，其中的一方去世，子女监护权/抚养权基本就会归另一方。但除非有特别情况，比如另一方存在吸毒或完全不具备抚养能力等情形。另外，死亡一方的父母也可以向另一方争取抚养权。 “大S去世后，汪小菲争取到两个子女抚养权的机会很大。”上海汉盛（成都）律师事务所律师蔡小莉介绍，大S的一双儿女主要生活在中国台湾地区，按照台湾地区有关规定，夫妻双方离婚后，原来约定行使监护权/抚养权的一方去世，子女的监护权/抚养权通常会转移到生存的一方。 在实际操作过程中，大S与汪小菲的两名子女都已年满8周岁，因此抚养权归属通常会考虑子女自己的意愿，并以子女的意愿为准；同时，还会从经济条件、与孩子的亲疏程度等多维度综合考虑两名子女的抚养权变更至汪小菲名下是否对子女最佳。 红星新闻记者 邱峻峰 编辑 李洁
